This website is operated by Mordialloc Florist. Throughout the site, the terms “we”, “us” and “our” refer to Mordialloc Florist. Mordialloc Florist offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 – SPECIAL TERMS

Floral Products

We only use the freshest, highest quality Real Flowers.   We make every effort to create as displayed however, due to seasonality our Real Florists will be trusted to select alternative exquisite flowers if your choice is not available. If you have any concerns with this please contact us on (03) 9587 8595 to discuss. To ensure fresh and quality product, some stems, including Lilies, may be closed when received. Additionally, due to high demand, some colours and varieties of flowers may need to be substituted to meet delivery times.

Delivery

Every reasonable effort will be made to deliver according to your time and date preferences however Mordialloc Florist cannot guarantee delivery times. Every effort will be made to notify you of the delivery success and time however Mordialloc Florist is unable to provide notification to the sender or recipient at the time of delivery.   It is the sender's responsibility to ensure the recipient is available to accept delivery and if the recipient is unavailable to accept delivery the flowers will be left at the nominated delivery address unless specific instructions are noted on the order under ‘special delivery notes’. No order containing alcohol will be left unattended. Where an order cannot be left at the delivery address, a calling card will be left and a redelivery fee may be incurred by the customer. Note that with the exception of Mother’s Day, we do not normally deliver on a Sunday however if you require special delivery, please call to discuss the options with us on (03) 9587 8595.

Changes & Cancellations

Please make sure all order details are correct at time of ordering. If you have issues or require changes please contact us immediately on (03) 9587 8595 to discuss options. Whilst we will endeavour to meet your requirements, we cannot guarantee being able to make those changes and the accuracy of the delivery address, contact details and product selection remains the responsibility of the purchaser.

Alcohol

Some products sold by Mordialloc Florist contain alcohol. You must be at least 18 years of age to place an order containing alcohol and the intended recipient must also be at least 18 to accept delivery.

SECTION 2 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We are not responsible if information made available on this site is not accurate, complete or current. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

RETURNS POLICY

We pride ourselves in our quality of service. If for any reason you find yourself unsatisfied with our services please do not hesitate to contact us.

Care instructions must be followed to increase the longevity of our floral products. If you need advice on caring for your flowers please click here or call us during business hours.

If your flowers should perish within 5 days and you have followed the care instructions and you are able to return the product or provide photos, we would be happy to re-send new flowers. If required, we can provide you with a store credit and in some circumstance a full refund, both excluding delivery fees.

Note that we only use the freshest, highest quality Real Flowers and we do make every effort to create products as displayed on our website however, due to seasonality our Real Florists will be trusted to select alternative exquisite flowers if your choice is not available. To ensure fresh and quality product, some stems, including Lilies, may be closed when received. Additionally, due to high demand, some colours and varieties of flowers may need to be substituted to meet delivery times. If we are required to make any adjustments to your order as per above, our refund and returns policies continue to apply.

For non-perishable products (eg, gifts other than food, flowers, plants, health and beauty goods), our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers cannot be returned but please contact us to discuss as per statements above. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

Additional non-returnable items:

• Gift cards
• Downloadable software products
• Some health and personal care items

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted (if applicable)

• Book with obvious signs of use
• Any item not in its original condition, is damaged or missing parts for reasons not due to our error
• Any item that is returned more than 30 days after delivery

Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at orders@mordiallocflorist.com.au.

Sale or Discounted items (if applicable)

Only regular priced items may be refunded, unfortunately sale and discounted items cannot be refunded.

Exchanges (if applicable)

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping

You will be responsible for paying for your own delivery costs for returning your item. Delivery and shipping costs are non-refundable. If you receive a refund, the cost of return delivery and shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are returning or delivering an item over $75, you should consider using a trackable shipping service or purchasing delivery insurance. We don’t guarantee that we will receive your returned item.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
